Framework for an America First AI Policy: A Roadmap to AI Dominance

Our America First AI Policies follow three core principals:

  1. Protect American liberty and national security from AI threats

  2. Require transparency and accountability from Big Tech

  3. Protect our children, our jobs, and our way of life

AI will supercharge our nation’s economy, improve our quality of life, and ensure we dominate around the world. But policy must always be focused on helping hardworking Americans and putting Humans First.

America can and must win the AI Race, but we also need to make sure Americans win as well.

Protect American liberty and national security from AI threats

  • Block adversary access to U.S. AI capacity. Tighten export controls on high-end chips and other critical AI technologies to China and other adversaries, including via third-countries. Prohibit Chinese control of U.S. data centers, the sale of U.S. data to China-based firms, and storage of U.S. data in Chinese data centers. Require security vetting of foreign personnel at frontier AI companies and strong protections against theft of AI models.

  • Mandate extreme-risk testing. The largest AI companies must have independent third-parties test their systems—including internal-only models—for severe economic and national-security risks, and fix failures that testing finds. Companies must be able to reliably show they will not impose extreme risks on the American people. No company is too large to be held accountable.

  • A red-line on the development of vastly superhuman AI. Prohibit its development at home and abroad, with enforceable domestic red lines that include a halt to recursive self-improvement, and strong action to avoid the breaching of red lines abroad.

  • End warrantless mass surveillance. Terminate federal use of Flock and similar camera networks. No search of a person—including searches of voluntarily obtained private data—without a warrant.

  • Harden elections against AI-enabled fraud. Require photo ID, audit and protect voter rolls against AI-driven cyberattacks, and ensure AI does not make it easier for non-citizens to vote or for other electoral fraud to occur.

Require transparency and accountability from Big Tech

  • Require public reporting of major AI incidents. Mandate disclosure of significant harms, including loss of life, loss of control, compromised safeguards, terrorist use, and substantial financial damage attributable to AI systems.

  • Grant no special status to the largest AI companies. Provide no liability shield, no taxpayer bailout, and no preferential treatment. Place the primary regulatory burden on frontier AI developers rather than startups.

  • Assign liability for reckless conduct. Hold frontier developers liable for reckless design and operators liable for reckless deployment.

Protect our children, our jobs, and our way of life

  • Protect our children. Impose a duty of care for minors, require parental consent and controls for AI use in schools and at home, mandate regular disclosure that a system is artificial, restrict features that foster sexual or emotional dependence in children, and prohibit AI-generated child sexual abuse material.

  • Direct the gains of AI leadership to American workers. Pair AI expansion with tax relief for workers, a pause on H-1B visas, domestic workforce training, and mandatory disclosure of AI-related job displacement.

  • Preserve our constitutional values. Require frontier systems to operate consistent with core constitutional principles. Frontier developers must disclose the values trained into their AI systems. Politically sensitive speech may not be restricted by private AI systems, and government may not use AI to censor speech.

  • Protect name, image, and likeness (NIL). Strengthen fraud enforcement, prohibit employers from requiring employees to permanently surrender NIL rights, and create private rights of action against AI providers that misuse a person’s identity.

  • Respect federalism. Oppose federal preemption of state AI laws. Conflicts that unduly burden interstate commerce should be resolved by the courts, not by federal override.

  • Pursue American AI leadership through narrow, controllable systems. Prioritize applications in health, agriculture, cybersecurity, robotics, logistics, and defense, and use AI to identify waste, fraud, and abuse in government.
